What Texas law requires before they fine you
These are your rights under the Texas Residential Property Owners Protection Act. We check your notice against every one.
Certified mail
Fine and lien notices must be sent by certified mail. A regular envelope may not count.
Texas Property Code §209.0091
A chance to fix it
For a curable violation, the HOA must give you a reasonable cure period before fining you.
Texas Property Code §209.006
Your right to a hearing
You can demand a hearing before the board before any fine or suspension takes effect.
Texas Property Code §209.007
No conflicts of interest
Board members can’t also sit on the architectural review committee deciding your case.
Texas Property Code §209.00505
You’re not alone — and you’re not powerless
“The HOA fined me with no warning, no hearing, no cure period. I didn’t even know I had rights.”
“They skipped the certified mail requirement. I found out from a neighbor. Is that legal?”
“They fined me for my EV charger cord, calling it an ‘extension cord.’ Ridiculous.”
